Terms of Service
Welcome to Koha Labs ("we," "our," or "us"). These Terms of Service govern your access to and use of the Koha website (https://kohaaa.com) and our AI-powered creative editor platform for Image, Video, and 3D generation (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
1. Account Registration and Security
To use certain features of the Service, you may be required to register for an account or beta access.
- You must provide accurate, current, and complete information during registration.
- You are responsible for safeguarding your account credentials and for all activities that occur under your account.
- You must promptly notify us of any unauthorized use of your account or security breaches.
2. Acceptable Use & AI Generation Rules
Koha is a creative playground designed to push the boundaries of digital art. However, you agree not to use our Service to generate, upload, or share content that:
- Is illegal, defamatory, harassing, abusive, or explicitly threatening.
- Promotes violence, self-harm, or illegal acts.
- Contains non-consensual explicit content or violates the privacy rights of others.
- Infringes on any third-party intellectual property rights, including copyrights, trademarks, or patents.
- Attempts to reverse engineer, decompile, or extract the source code or underlying AI models of the Koha platform.
We reserve the right to suspend or terminate your access immediately if you violate these rules.
3. Intellectual Property & Content Ownership
A. Your Content:
You retain all ownership rights to the original text prompts, images, or 3D assets you input into the Service ("Input Content"). Subject to your compliance with these Terms, you also own the rights to the AI-generated outputs ("Output Content") you create using Koha.
B. Our License:
By using the Service, you grant Koha Labs a worldwide, non-exclusive, royalty-free license to host, store, process, and transmit your Input and Output Content solely for the purpose of operating, maintaining, and improving the Service.
C. Koha Labs' Property:
The Service itself, including its code, interface design, branding, and underlying architecture, is the exclusive property of Koha Labs. You may not copy, modify, or distribute our proprietary assets without our explicit written consent.
4. Third-Party Services
Our Service utilizes third-party AI models, hosting providers, and analytics tools to function. Your use of the Service is also subject to the acceptable use policies of our underlying infrastructure partners. We are not responsible for the availability, accuracy, or performance of these third-party services.
5. Disclaimers ("As Is" Basis)
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Koha Labs makes no warranties, either express or implied, regarding the reliability, accuracy, or continuous availability of the Service. Because AI generation is inherently unpredictable, we do not guarantee that the Output Content will always meet your specific expectations or be error-free.
6. Limitation of Liability
To the maximum extent permitted by law, Koha Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your access to or inability to access the Service.
- Any conduct or content of any third party on the Service.
- Any AI-generated outputs produced by your use of the Service.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Sri Lanka, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Sri Lanka.
8. Changes to These Terms
We reserve the right to modify or replace these Terms at any time. We will provide notice of any material changes by updating the "Effective Date" at the top of this document or by sending you an email. Your continued use of the Service after changes become effective constitutes your acceptance of the new Terms.
